GENERAL TERMS AND CONDITIONS OF SALE

Definition

The terms used herein have the meaning given to them below:

"Customer": refers to a natural person of legal age, acting in his or her personal or professional interests and having full legal capacity to commit to the present terms and conditions.

"Hotel": refers to the Contact Hôtel du Ladhof (operated by Ladhof SARL, 198 rue du Ladhof, 68000 Colmar, RCS Colmar n° 316 137 769)

"Party"; "Parties": refers to the Client or the Hotel, separately or together.
 

Application

These General Terms and Conditions of Sale (hereinafter referred to as "GTCS") shall apply to sales transactions concluded by the Hotel with the Customer.

By submitting a reservation request, the Customer accepts these GTCS in their entirety. The General Terms and Conditions of Business may be supplemented by special terms and conditions of sale that appear in the description of the service.

The Hotel reserves the right at any time not to enter into a contract with a Customer who contravenes these GTCS.
 

Capacity

The Customer declares that he/she has full legal capacity to enter into a contract under these GTCS, i.e. that he/she has reached the age of majority and that he/she is not subject to a guardianship or tutelage arrangement.
 

Prices and services

The prices are indicated in euros. Each transaction is in euros. VAT is included in the prices quoted. Any change in the applicable rate will be automatically reflected in the prices indicated on the date of invoicing.

The prices indicated correspond to the services strictly mentioned and described in the reservation, without any additional services that may be provided by the Hotel (taxi, meals, etc.) during the stay and, where applicable, the tourist tax.

The rates will only be final at the time of confirmation of the reservation. Only the price indicated in the booking confirmation by the Hotel is binding.
 

Reservation/change of reservation and cancellation procedures

When making a reservation, the Customer must provide his/her contact details and bank details.

The reservation shall only be firm and definitive once it has been confirmed by the Hotel. Confirmation of the order implies acceptance of these GTCS. The Hotel shall send the Customer confirmation of the reservation by any means.

The Hotel reserves the right to request full payment or a deposit from the Customer for certain reservations. The latter may be payable by cheque or credit card. In this case, the reservation shall be final upon receipt of the payment and the additional amount requested by the Hotel must be paid within the time limit specified.

Changes to a stay can be made up to 72 hours before the start of the stay at the latest. This change is only accepted when confirmed by the Hotel. If the hotel refuses to accept the change, the cancellation conditions set out below may be applied.

Cancellation of a stay may be made on site (Hôtel Restaurant du Ladhof, 198 rue du Ladhof, 68000 Colmar), by e-mail (hotelduladhof@hotmail.fr) or telephone (0389410978) only. It is only effective upon receipt by the Customer of the confirmation issued by the Hotel.

If the Client does not cancel and does not show up on the date of the stay, the full amount of the contract will be charged. No refund will be possible once the invoice has been issued.

The cancellation conditions are as follows:

  • Deposits are not refundable under any circumstances;
  • In the event of cancellation within 72 hours before the start of the stay: the entire stay will be charged

Time of arrival - Time of departure - Handing over of keys

The Hotel asks the Client to plan to arrive between 5 pm and 9 pm. No arrivals between the times indicated are possible. In the event of arrival after the time indicated above, the reservation will be considered cancelled and charges will be applied at the expense of the Client, in accordance with these GTCS.

The Hotel requests the Client to plan to leave by 11:00 a.m. at the latest. If the room is not vacated by the time indicated by the Hotel, an additional night may be charged to the Customer.

The keys to the reserved room(s) will be given to the Client on arrival. They must be returned by 11 a.m. on the day of departure at the latest. If the keys are not returned, the Hotel may charge the Customer for the creation of a new key and a new key ring. The Hotel may also charge for all nights during which the room cannot be rented as a result.
 

Responsibilities 

The Hotel declines all responsibility in the event of theft, loss or damage to the Client's belongings during his/her stay.

The Client will be held responsible for any damage, deterioration or any act of vandalism that may occur during the stay, due to the occupation of the premises. In the event of damage to the premises (theft, destruction of furniture or any other act of vandalism), the Hotel may charge the Customer a fee for repairing the damage caused. The Hotel may also charge for all nights during which the room cannot be rented.
 

Force majeure

Force majeure shall mean any event external to the parties that is both unforeseeable and insurmountable and that prevents the Hotel or the Customer from fulfilling all or part of its obligations under the agreement (in particular, in the event of a strike, riot, exceptional legal obligations or insurrection).

It is expressly agreed that cases of force majeure suspend the performance of the obligations of both parties and that each party shall bear the costs of the suspension of the contract. In particular, the client shall bear the additional costs that may be incurred in order to continue the journey.
 

Complaints

Any complaint must be made within thirty days of the end of the stay and addressed directly to the Hotel at the following address Hôtel Restaurant du Ladhof, 198 rue du Ladhof, 68000 Colmar. After this period, no claim can be taken into account.
 

Data processing and liberties

In application of Law L.78-17 of 6 January 1978 relating to information technology, files and freedoms, the Client is informed that the information provided to the Hotel in the context of their reservation is subject to computer processing, unless they expressly object.

The Customer has the right to access, rectify and delete the data entered, which may be exercised by contacting the Hotel: Hôtel Restaurant du Ladhof, 198 rue du Ladhof, 68000 Colmar.

The Hotel undertakes never to use this data for any transaction other than that of reservation and sale within the Hotel. This information is not communicated to third parties.

The Hotel has a video surveillance system in its car park.
 

Applicable law

These GTCS are governed by French law.

Any dispute between the Customer and the Hotel is subject to French law and falls under the exclusive jurisdiction of the French courts.
